Effective October 6, 2026
These Terms of Service ("Terms") are a legal agreement between you and Lilly Bean Collective, LLC ("LBC", "we", "us") governing your use of the Lilly Bean Collective pet adoption platform (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to the organization as well as to you personally.
The Service is a platform that:
We are not an animal shelter or a rescue. We do not own, house, transport, or rehome any animal, and we are not a party to any adoption.
To use certain features you must create an account. You agree to:
You must be at least 18 years old to create an account. By creating one, you represent that you meet this requirement.
You may close your account at any time. We may suspend or terminate an account that violates these Terms or creates risk for other users or for the animals involved. Where it is reasonable to do so, we will tell you why.
You agree not to:
Additional conduct expectations are set out in our Acceptable Use Policy, which forms part of these Terms.
Organizations listing an animal must ensure the listing is accurate, including:
Listings are not permitted for:
Organizations agree to update or remove a listing once the animal is no longer available.
We do not guarantee any adoption outcome. Every adoption is subject to the approval of the organization handling it, and they may decline an application for reasons that are theirs to determine.
An adoption may be governed by a separate agreement between you and the organization. We are not a party to that agreement and have no role in enforcing it.
Adoption fees are set by the organization, not by us. LBC does not collect adoption fees.
Some organizations handle their own applications on their own website. When a listing takes you off the Service, that site's terms and privacy practices apply, and we are not responsible for what happens there.
The Service, and its original content, features, and functionality, are owned by Lilly Bean Collective, LLC and are protected by copyright, trademark, and other intellectual property laws.
You keep ownership of the content you post, including photographs and listing text. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as part of operating and promoting the Service. This license ends when you delete the content, except where it has been shared with others or retained as described in our Privacy Policy.
You confirm that you hold the rights needed to post the content you upload, particularly photographs of animals.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
WE DO NOT WARRANT THE HEALTH, TEMPERAMENT, OR SUITABILITY OF ANY ANIMAL LISTED ON THE SERVICE, AND WE DO NOT VERIFY THE ACCURACY OF WHAT AN ORGANIZATION PUBLISHES. WE STRONGLY RECOMMEND THAT YOU HAVE ANY ANIMAL EXAMINED BY A VETERINARIAN AND THAT YOU SATISFY YOURSELF THE PLACEMENT IS A GOOD FIT.
The Service links to third-party websites and, where an organization has enabled it, uses a third-party electronic signature service. We are not responsible for the content, availability, or practices of those third parties.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LILLY BEAN COLLECTIVE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the above may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless Lilly Bean Collective, LLC and its officers, members, and agents from any claim, damage, or expense, including reasonable legal fees, arising from your use of the Service, your breach of these Terms, your violation of another party's rights, or an adoption you arrange through the Service. This obligation survives the end of your use of the Service.
We may add, change, suspend, or discontinue features of the Service. Where a change materially reduces what an organization's paid subscription provides, we will give reasonable notice.
We may update these Terms as the Service or the law changes. When we do, we will update the effective date at the top of this page and, for a material change, notify you by email or by a notice on the Service. Continued use after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles. Subject to the dispute resolution section below, the state and federal courts located in Travis County, Texas have exclusive jurisdiction over any dispute arising from these Terms or the Service.
Before starting a formal proceeding, please email legal@lillybeancollective.io with a description of the issue and what resolution you are seeking. We will try in good faith to resolve it within 30 days.
Neither party will start arbitration until 30 days after that notice is sent, unless the claim concerns misuse of intellectual property or a breach of confidentiality.
If we cannot resolve the dispute informally, it will be settled by binding arbitration administered in Texas before a single arbitrator, under the rules of a recognized arbitration provider. The arbitrator may award the same relief a court could, and judgment on the award may be entered in any court with jurisdiction.
The following are not subject to the arbitration agreement above, and either party may pursue them in court:
To the extent permitted by law, disputes will be brought individually and not as part of a class or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@lillybeancollective.io with your name, the email address on your account, and a statement that you wish to opt out. Opting out does not affect any other part of these Terms.
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. If a provision is removed, the parties will replace it with a lawful provision that best reflects the original intent.
